Fraud and Deficiency of Service

I purchased a car, the model name being Santro Xing XO ERLX Euro 3 from Modi motors by paying Rs. 1,60,0000/- on 25th October 2012. I was the third owner of the car, according to the registration paper shown (the registration no of the car being MH 01 AC 4209) and it was sold to me by Mr Ajit in ASIS condition. I was told that I would get one year warranty on engine and gearbox along with two free services in a year.It was assured from your end that the car is in good condition and there will be no problem with its working.
However, after driving the car for few days only I started facing problems with it. The car used to get switched off post running few kilometres whenever I used to change gears and did not release the clutch correctly or whenever I used to stop the car for about a minute and tried starting it again. Also car would not start immediately and would take about 10-15 minutes to start. On consulting Mr Ajit, he told me to get it checked outside since your company will charge more for sorting out the problem. The mechanic outside suggested me to use the car for some more. On using the car for some more time it was found that the problem continued and so I again consulted your company for the solution. It was predicted from your side that the problem might be with the battery not being charged. So I took the car to the authorized Exide personnel and a new battery for Rs. 3,700/- was put up.
After this the car worked well for 4-5 days but then the problem started again. The car stopped on the main road and got started again only after extreme efforts of 10 minutes. Adding on to this, the radiator pipe also burst.
The next day I called a mechanic form Reena Auto garage near Mindspace for other opinion since Hyundai personnel had not been helpful till date. The mechanic told that the radiator pipe has burst, water had mixed with the coolant and also there is some problem with the gasket and the total cost of repairing will come as Rs. 8,000/-. He also told that I should check with your company as the car is under warranty for the engine and the gear box.
On contacting your company, Mr Satinder the manager of your company made arrangements and collected my car from Reena garage for rectifying the issue. He asked me to send my approval for Rs. 6,500 for rectifying the entire problem and assured that I would not face any further problem once it is rectified. The car was finally delivered to me on 26th November 2012. After driving for 4 minutes only, the problem started again and it got off on the mid chowki signal. The personnel from your company came, checked and told that it was some problem with the connection of the battery that has been rectified now and assured that no problem will occur from now onward.
Again after few more minutes the car got switched off and your personnel refused to come for help. After 15 minutes of long effort the car started and immediately I drove it your company to give it back. Mr Ajit tried starting the car but could not start. The very next day I came to your office for consulting Mr Satinder and I was informed that there is no problem with the car and insinuating that I am lying. I got Satinder to test drive it. In the test, Mr Satinder witnessed the problem personally as the car got switched off and didn’t start again.
Mr Satinder assured me that the problem will be solved and also arranged meeting with Mr Bonie, the general manager. Finally the car was handed over to me again after the repairs. It was well for 1 day but again the same problem occurred the other day and the car was given to your workshop. Again the car was handed over to me on 8th December 2012 with the same assurance that it is perfectly fine. Post this, no issues with car switching off occurred but the A/c stopped working. On getting it checked with your personnel at first it was told that there is no problem and all it needs is for us to blow some air and sprinkle some water but later, on opening the bonnet it was found that it was making a regular noise and that it was getting cut again and again. Further, I was called and told that I will have to split the cost for repairing the issue with AC.
The car was once again handed over to me on Dec 14th but once again the problem was not solved. On driving the car it was found that steering column was regularly vibrating strongly at intervals of 5 seconds and also the cutting off problem with AC was still on-going. As per the instructions of Mr Boney the car was kept with me till 27th December as he was going on leave .
I handed the car over to Hyundai on 2nd of January 2013 and got it back on 7th Jan. After using for some time the problem started again. On 13th January 2013 it was written to Mr Bonie about the problems again found after the test drive of 6 days. The main problems were starting trouble – on many occasions, the car would not start unless the accelerator is used, also, when the AC is put on, the engine seems to struggle and make a different sound. The initial problem of vibrating steering wheel and engine started again which your team supposedly resolved. It was also noticed that if the clutch is released a little and the car is stationary, the entire engine and car shakes violently.
Note:
A detailed bill has still not provided to me for the cost of Rs 6500 inspite of repeated requests.Also the car documents were not provided to me inspite of your team claiming registration of the vehicle in my name only after 14 days of selling.
Again on 15th December 2013 when I turned on the car ignition, it made a weird sound and also I struggled to start the car without using the accelerator and also the car became direct and the lights went on. Mr. David from your company visited my place and checked the car but didn’t resolve the problem and the excuse given by Mr David was no petrol for an electrical problem. This is the best example showing the incompetency of your personnel.
I also discovered some documents (delivery Challan and bill dated 15th October 2012) which show that the car was sold to a certain Candido Fernandez 10 days before selling it to me. This fact was hidden from me and does not show in Registration documents as the customer sold it back to them before the transfer. It seems that at that time also water was mixing with the little coolant left and it required the engine to be opened up.
Clearly the car was sold to me in this condition which caused the radiator pipe burst when I started using it and later your team asking me to pay Rs 6500 to rectify the issue!
