FRAUD/JOSY MATHEW/STAYYING,COM

I entered into a mutually binding agreement with Mr Josy Mathew (THE COMPLAINEE) vide agreement certificate no. IN-KA76872855078736Q issue date 22 Jan 2018, 11:49 AM, wherein it was agreed that the complainee would take my apartment C802, HRC Ibbani, Jakkur, Bangalore – 64 on lease for a period of 60 months and pay me a rent of 25,000/- (twenty five thousand only) with an annual increment of 5%. The maintenance charges and club subscription charges were to be borne by the complainee.
In addition, the complainee was to carry out the interior woodwork, fixtures and fittings of the house prior renting. This was a precondition for the lease. Arguably for ease of maintenance at a later date. The cost of the wood work fixtures and fittings was fixed as 3 lakhs plus 18% GST for my flat. The work would be executed by Keep Stayying TechnologiesPvt Ltd through “The Perfect Inch Interiors” a sister concern of Josy Mathew.
The expenditure for woodwork, fixtures and fittings was was to be shared equally between myself and Keep Stayying Technologies Pvt Ltd. (INR 1,77,000/- each). I was made to pay in two installments of 88500/- each on 21 Jan 2018 and 25 Jan 2018 through NEFT transfer to bank account of The Perfect Inch Interiors.
The agreement stipulated that the wood work, Fixtures and fittings work would start by end Jan 2018 and complete by end Feb 2018. The rent was fixed to commence from 05 Mar 2018.
Despite continuous follow up, no work happened in the apartment. When confronted in end Apr 2018 for not starting any work against the payment made, Mr Josy indicated that he is unable to progress due to Financial problems and management issues. On 02 may 2018, he agreed to terminate the contract. I visited the registered address on 03 May 2018 in search of the office of Keep Stayying Technologies Pvt Ltd to Koramangala. However the place was already vacated by the firm, without any notice of where they had moved. Mr Josy refused to share the details of his new office despite repeated reminders.
Mr Josy arranged to hand over the keys of my apartment through one of his employees Mr Shailesh, mob no. 9036553355. He met me at Hebbal junction on 06 may at around 1300hrs to hand over the keys of my apartment. (he was in a black color swift car).
On 06 may 2018, Mr Josy told me that he would pay the balance amount of Rs 1.77 lakhs by 15 May 2018. As a follow up to that I forwarded a whatsapp message to him with my bank details ( image of my cheque leaf), UPI address and paytm number on 06 May 2018 at 1445hrs.
Thereafter he has been avoiding all phone calls from me.
