Subject: Complaint about misrepresentation by making false commitments /assurances / guarantees made by the Company (M/s Sharman Hospitality Services Pvt. Ltd.) for selling their products and services to lure/attract innocent public and thereby cheat them.
I received a call on 16th May, 2016 from M/s Sharman Hospitality Pvt. Ltd., having its Office at E-3/14, DLF Phase-I, Gurgaon-122 002 through its representative
Ms. Komal (Ph. 9717456626). She told me that her Company is associated with a
5* hotel of repute, named as, ‘Country Inn & suites’ which is a newly launched hotel on Sohna Road, Gurgaon – 122 102. She offered me many lucrative offers regarding the new ‘Country Inn Hotel & Suits’. Finally she offered me Two (2) complementary night stays along with various hotel discount vouchers for a total price of Rs.8,973/- (Rupees Eight Thousand Nine Hundred Seventy Three Only), which is valid for one year i.e. till 30/05/2017. She assured me that I can use these complementary night stays at any time during this one year by giving a call just two days before.
Relying exclusively upon her assurances & commitments about their products & services and believing them to be true, I purchased the same by paying the offered price of Rs.8,973/- (Rupees Eight Thousand Nine Hundred Seventy Three Only) on dated 16/05/2016 through my credit card. After passing few days, I received a membership card of Club Carlson bearing no.6015 9957 6512 6664 along with some discount vouchers.
More than seven months have passed after become a member of this hotel, I had tried hard so many times in this span of seven months to use my complementary night stay on my various occasions like, my birth day (19th June), daughter’s birthday (17th November), my marriage anniversary (12th December) and on some holidays plans lastly on 14th January 2017 but unfortunately I never succeeded. Every time when I called in the company as well as Ms. Komal, they told me that the entire hotel is booked for the whole month and I could not use my benefits as promised by M/s Sharman Hospitality Services Pvt Ltd. on my chosen dates within the promised period. After refusal by M/s Sharman and its executive Ms. Komal for 14th January 2017, I directly called the said Country Inn Hotel, whereupon I was told that they have enough availability in the hotel rooms for 14th January 2017 and they always had in the past also on my chosen dates but as per their third party contract with M/s Sharman Hospitality, I have to book my room through M/s Sharman Hospitality only and they cannot entertain me directly. When I asked the hotel executive that I have its membership card as well and having all its discount vouchers with me which were issued by the hotel itself then how can they refuse me to use my benefits under this scheme. They again told me that under that third party contract, they are helpless to book my room under complementary night stay under the scheme prepared by the Country-Inn- Hotel and M/s Sharman Hospitality mutually.
At last, after I made each & every effort on my part, I felt I got cheated, humiliated and embarrassed by both M/s Sharman Hospitality and hotel Country Inn. Finally I thought that the whole scheme was framed by these two Companies i.e. Sharman Hospitality and hotel Country Inn to lure/attract the innocent people and cheat them to which I felt trap. It is very clear that M/s Sharman Hospitality and the management of hotel Country Inn have entered into a criminal conspiracy to make falls representations to gullible customer by making them very lucrative offers and inducing them to pay large sums of money knowing fully well that they are not going to act upon their representations. They had this intension of cheating since the very first day and never intended to act upon their words. They have thus committed the offence of cheating and are liable to be tried and punished in accordance with law.
