Received Broken Mobile- and still No resolution

I had received a broken OnePlus One on 28th of Sep, 2015. And I raised the claim at Ebay Gaurantee. Claim id is 129275.
As per the ebay policy, within 20 days of raising the claim, the buyer gets the resolution. and this is 21st day and I have not got even a single response.
I have been calling them since 28th Sep, 2015. Everytime, I was asked to wait for 24 hrs to get an update. But, there were no responses in those 24 hrs. And I did not get any Call/Message/acknowledgement from ebay.
Today is 21st day of raising the claim and I still don’t have any clue of what I will get in return? On top of all, on calling Ebay care today, I was asked to wait for more 72 hrs from now. This is more than worse to any normal person.

I seek the justice from Consumer forum, INDIA.
