gave a broken item now refusing to replace/refund

i bought a 30 watt led flood lamp from krushnacommunication through ebay . he called me and asked me for the same amount they are ready to ship a 50 watt which cost me than 30watt. i was ok with that ,
i got the item broken upon contacting with the seller he asked me to send the item back for refund and replacement i sent on my own expenses of rs 560 .. .
now he is refusing to replace / return the item telling the item is broken .

i raise a claim on ebay but it got closed they telling they were not able to contact my phone on time
