defective phone

i bought a nokia ASHA 300 phone which had some software problem in it n the touch wasnt working. i had given the phone to nokia priority dealer from whom i purchased d phone .the dealer took the phone with a promise to return after getting the problem fixed.it took a long time and when i got d phone back , it was still not working. then i was told he is sending it to delhi n the touch will be changed. it took many mnths but sorry to say even then the phone wasnt working. its the third time my phone has been sent to the company .i dont want to accept dat same defective phone now n as per terms n conditions of nokia i shud be given a replacement but the company hasnt done anything till now. its been so many mnths now. i want my money back now.
