Thought of sharing some ugly experience of my friend with Omaxe Ltd., and seeking advice from professionals so that he can take necessary step.
a)He invested in Omaxe Sonepat Project in 2005 and paid 50% advance.
b)He received first communication from Omaxe in 2010 which had an error in Basic sale price i.e quoted higher then agreed rate (discount not taken into consideration)
c)My friend communicated the same to Omaxe several times (thru mail and thru Registered post)
d)Omaxe never bothered to communicate against his letters nor asked him to pay the amount
e)He received reminder-1
f)He again approached Omaxe (Personally, thru email, thru registered post- all) again no response
g)He received corrected communication in Reminder-2 letter with correct calcualtion and hence he made the payment within 10 days of reminder-2
h)He again receives final letter from Omaxe in May 2013 asking him to make full and final payment and take the possession but this letter also has interest component towards late payment.
i)He approached again to Omaxe, executive says he has to pay interest component but they will reduce the interest rate.
SO LIKE TO KNOW — Do OMAXE HAS LEGAL RIGHT TO CLAIM INTEREST ESPECIALLY WHEN MY FRIEND INFORMED THEM SO MANY TIMES REGARDING ERROR AND INSTEAD OF CORERCTING OR COMMUNICATING THEY ARE CHARGING INTEREST W/O ANY FAULT OF HIS. OMAXE INSTEAD OF PENALIZING HIS/HER OWN STAFF WOULD LIKE TO RECOVER MONEY FROM CLIENTS FOR THEIR OWN INEFFICIENCY.
