Harassment calls from Pheonix ARC for Barclay / Kotak Credit Card after 6 years

Name of company/service: Pheonix ARC Pvt. Ltd.

I have been receiving threatening, obscene and harassment calls on my number which is +91 9594966602 from three numbers +91 22 6742 4516, +91 22 6742 4517 and +91 22 67424514 from some Mr. Ankit & Ms. Nandini. The person clams to be calling from Kotak Mahindra Bank and is threatening and using extremely obscene language. I have received various calls a day from 23-05-2013 till date. I have spoken to him calmly and explained that it’s a disputed matter which I have sorted out with the Barclays bank officials however he has started to call my wife, my & my wife’s friends and my and my wife’s colleagues and threaten them too since 23-05-2013. The person claims and threatens the following.

1. He calls my wife’s friends and states that she has given reference of them through email to call on her behalf for collection.
2. He has been calling on the personal numbers of my & my wife’s friends and colleagues, which I or she has never provided to Kotak or Barclays Bank. On asking the agent that from where he has received the personal numbers of my & my wife’s friends and colleagues he never replies properly.
3. He calls all our friends and colleagues and says that I and my wife are fraud and have disclosed our personal details which were with bank also he uses obscene language with them to put pressure on me and my wife to make payments.
4. They call continuously to me, my wife and our friends and colleagues and threaten and not at all listen to what the person is trying to say.

He has been passing obscene abusive comments to my family members and me. This is a 5 years old account which was spoken and settled with Barclays bank in the year 2008 -09 and after that did not receive any calls, letters or any person from bank visiting my house for collection from Barclays bank since the year 2008 – 09 till date.

Also as per RBI rules and guidelines (Code of conduct for Collection of Dues – Credit Card) the Collection Agent has to call only the Card holder and not to the family members or their friends and colleagues nor disclose the personal details with the bank to others then the card holder. Also he cannot call and threaten or force to make payments.
The person has been abusing and threatening me, my wife, my & my wife’s friends and my and my wife’s colleagues. Request actions on the same ASAP or shall be logging an FIR and will be filing a case against Kotak as these are unfair debt collection practices.

    Hi I’m having the same problem I did put a comment on this forum and kotak have given me the same answer I also send them a mail regarding that to the address that they gave me in this forum [email protected] but nothing has been done I’m still receiving this calls has anything happened or has kotak been able to help u if yes then kindly guide me for the same
    I have decides to go to the police tomorrow and file a complaint and see wht is the next step

    This is ramesh. I had used a barclays credit card in 2008 and due to dispute in my late payment charges i called the customer care in mumbai. I told the rep that i cannot pay for late payment as i was paying the minimum due on time. The rep put my call on hold for long and came back saying i have to make the payment. I got irritated and told them that i will send back the card. The rep gave me the address in mumbai and asked me to cut the card and send it back to them. After 8 years their collection agency Phoenix is calling me and my work place and the lady is using very filthy language and threatening that unless i pay the entire amount they will come to my work place. They keep calling my number everyday and coming to my work place and harrasing me. Please help. I cannot make any payment now as it is time bound and more over already my negative rating is updated by barclays in cibil. please advice.

    Hi Kotak Team.
    Same issue is now started with me. I had used a barclays credit card in 2008-09 and my limit was 12000/- which i get settled by them now after 8 years i start receiving call to pay 35000/- which is out of my mind. A lady called from pune as asking for payment.

    kotak being such reputed bank how can call custmer in such bad manner.

    same problem is being faced by me.
    Some phoneix agency is calling everyone i know for some credit card payment issue done by my father.
    They say they are authorised by Kotak bank.
    I am in no way Liable to pay any of these amount.
    I have got minimum 50 calls in a day.
    This payment was due in 2006 and my father had made this payment but for obvious reasons, he does not have proof of the same after 12 years.

    Hi kotak is constantly calling my previous organistion for my ex wifes loan from barclays. I told them that we have seperated n does not live with me. I have no trace of her but they r still harrassing and calling and contacting me . My previous collegues were fed up and gave my number. I receive calls every day inspite of tellIng them i dnt have a clue of her. They still call me constantly and asKing me to pay for it . The answer I get from the agent is I was with her 10 years ago when she took the loan and I am entitled to pay for it.
    I am mentally been harassed by your bank. I need your guys to stop calling me. I will ask your bank to pay compensation for the mental torture get from them My name is Anthony vallladares 8655624895.   9. used Barclay card in 2006 or 2007 can’t remember because I changed bank the NEFT for payment dint happen the CD dept. send somebody home every month to collect payment. once the payment was done…I got a call stating non payment ..no phone no. provides to call back..I live in BNG found out they have an office in Mumbai..called multiple times back in those days STD charges was put on hold multiple time when I asked for supervisor with a promise of call back which never happened..1 time got through to a supervisor who said the FOS guy absconded service and didn’t make payments he will escalate the issue…collection called stopped I assumed that issue got sorted now every 2 to 3 years I get treating calls from people unwilling to listen to my issue and insisting on settlement…amount is minimal but it’s the attitude and the audacity of Mr Khan from Kotak that amazes me calling my husband and treatning him…revently I got call from a guy stating he is calling from the court and to talk to a lawyer or I be summoned to the police station for what????
