I purchased an inflatable airsofa from ebay on 5th of February 2013. The Item code is 321067363058 and the paisapay payment id is 33079765059 under which an amount of Rupees 3948 was debited from my bank account to ebay. The seller’s detail is given below ( Third Party seller selling under ebay’s brand name )

I received the product on 12th February and noticed that there is a leak in the sofa. Please note that as this is a inflatable item, even one leak affects the efficiency. When i contacted the seller i dint not receive a positive response from him. He rather asked me to use the repair patch provided with the package to seal the leak. Its only after i realized that there might be more than 1 leaks in the product i contacted the seller and asked him to send a replacement. As seller asked, i sent back the defective product with all the attachments and the original packet by DTDC courier ( D11528660) which was delivered to the seller on 27th feb. After that i didnt hear anything from the seller for about 1 week. I called him several times, but he gave me excuses of being out of town, being busy in family functions etc. Later on i realized that he did it intentionally so that i will miss the warranty period given by eBay of 1 month. After being frustrated with the seller, i raised a refund claim with eBay on 12th March 2013

After calling ebay for several times i was told that eBay will contact the seller and will inform me about the resolution ( Refund / Replacement) Although i asked for a refund i was insisted on for a replacement. Only after this, the seller responded by saying that he will send me a replacement. On my call to eBay support i was told that the seller will send me the shipping details of the replacement in 2 business days. I didnt hear anything in 4 days, neither from seller nor from eBay. I called them back and i was told that the seller has shipped the product the day before and it will reach me in 5-6 working days.
Seller sent me the product through professional courier, who are so professional that in spite of being located in my neighborhood, did nt deliver the product in 20 days. Finally i had to go and collect it from their shop after about a month.
Once i opened the product i discovered that its the same defective product that i sent to the seller one month back has been sent back to me again. The repair patch still there on the air sofa where i put it earlier. ( Pictures attached ). The air blower which is included in the package and which i sent back to the seller the 1st time is missing. The repair patch is missing which should have been in a new package.
Again out of frustration i called ebay. After calling for about 10 times, i was told that as a replacement has been sent to me, the claim is closed now and nothing more can be done. I sent an email to eBay grievance email address. [email protected]
An analyst called me, took all the details ( I sent the pictures of the leak still present in the replacement product ) and promised me that he will arrange a conference call with the seller in a few days. In the conference call the seller didn’t admit that he has sent me the same defective product again. He also blamed me of not sending him the attachments with the product and that when he received the package, the attachments were missing. As we couldnt reach an agreement, the conference call ended without success.
Later on the same eBay analyst called me, and gave me a rather ridiculous solution. He offered me that the seller will send me an air pump ( worth 500-600 Rs) but not the air sofa itself. His words were ” Sir, since you have the airsofa but dont have an air blower, if we send you the air blower, you should be able to manage with that.) no other resolution is possible. When i told me that i dnt want anything else now but my money back, he said ” okay sir, i will le tyou know ” and disconnected the call. I didnt hear anything from them after that. I still have that air sofa with leaks and i dont have the air pump I dont know what to do with it. I posted the same incident with details of ebay support individuals with their names and designations the same day on ebay’s customer forum, But it was removed and i was given a warning that doing so again will cause my account to be banned .
I am attaching a word file with with screenshots of communications with the seller, phone calls made to the seller and eBay in this regard ( Date/ Time) , chat transcript of communication with Ebay support chat, pictures of the defective product.
