Fraud eBay seller and eBay’s reluctance for refund

Sir,

I am Prakash Mishra and my ebay Customer ID is prakashmishra2008.

I purchased an inflatable airsofa from ebay on 5th of February 2013. The Item code is 321067363058 and the paisapay payment id is 33079765059 under which an amount of Rupees 3948 was debited from my bank account to ebay. The seller’s detail is given below ( Third Party seller selling under ebay’s brand name )

I received the product on 12th February and noticed that there is a leak in the sofa. Please note that as this is a inflatable item, even one leak affects the efficiency. When i contacted the seller i dint not receive a positive response from him. He rather asked me to use the repair patch provided with the package to seal the leak. Its only after i realized that there might be more than 1 leaks in the product i contacted the seller and asked him to send a replacement. As seller asked, i sent back the defective product with all the attachments and the original packet by DTDC courier ( D11528660) which was delivered to the seller on 27th feb. After that i didnt hear anything from the seller for about 1 week. I called him several times, but he gave me excuses of being out of town, being busy in family functions etc. Later on i realized that he did it intentionally so that i will miss the warranty period given by eBay of 1 month. After being frustrated with the seller, i raised a refund claim with eBay on 12th March 2013

After calling ebay for several times i was told that eBay will contact the seller and will inform me about the resolution ( Refund / Replacement) Although i asked for a refund i was insisted on for a replacement. Only after this, the seller responded by saying that he will send me a replacement. On my call to eBay support i was told that the seller will send me the shipping details of the replacement in 2 business days. I didnt hear anything in 4 days, neither from seller nor from eBay. I called them back and i was told that the seller has shipped the product the day before and it will reach me in 5-6 working days.

Seller sent me the product through professional courier, who are so professional that in spite of being located in my neighborhood, did nt deliver the product in 20 days. Finally i had to go and collect it from their shop after about a month.

Once i opened the product i discovered that its the same defective product that i sent to the seller one month back has been sent back to me again. The repair patch still there on the air sofa where i put it earlier. ( Pictures attached ). The air blower which is included in the package and which i sent back to the seller the 1st time is missing. The repair patch is missing which should have been in a new package.

Again out of frustration i called ebay. After calling for about 10 times, i was told that as a replacement has been sent to me, the claim is closed now and nothing more can be done. I sent an email to eBay grievance email address. [email protected]

An analyst called me, took all the details ( I sent the pictures of the leak still present in the replacement product ) and promised me that he will arrange a conference call with the seller in a few days. In the conference call the seller didn’t admit that he has sent me the same defective product again. He also blamed me of not sending him the attachments with the product and that when he received the package, the attachments were missing. As we couldnt reach an agreement, the conference call ended without success.

Later on the same eBay analyst called me, and gave me a rather ridiculous solution. He offered me that the seller will send me an air pump ( worth 500-600 Rs) but not the air sofa itself. His words were ” Sir, since you have the airsofa but dont have an air blower, if we send you the air blower, you should be able to manage with that.) no other resolution is possible. When i told me that i dnt want anything else now but my money back, he said ” okay sir, i will le tyou know ” and disconnected the call. I didnt hear anything from them after that. I still have that air sofa with leaks and i dont have the air pump I dont know what to do with it. I posted the same incident with details of ebay support individuals with their names and designations the same day on ebay’s customer forum, But it was removed and i was given a warning that doing so again will cause my account to be banned .

I am attaching a word file with with screenshots of communications with the seller, phone calls made to the seller and eBay in this regard ( Date/ Time) , chat transcript of communication with Ebay support chat, pictures of the defective product.

Please note that i am an eBay customer since 4-5 years and i have a 100 % positive feedback on eBay. Please let me know if any other details are required in this regard . I can be contacted on on mobile number or email id.

    I had the same experience for this seller – Supertradex12.

    He is a cheat and so is Ebay. They have made my life miserable. I am tired of contacting this seller and he is not getting back now. I got a Casio Watch from him and it turned out to be a fake. He asked me to send the product, I did so and now he is not refunding my money. I have lost my money and my watch.

    Recently, I bought Samsung power bank from ebay website from seller named “rajatnigam1”. I am 100% sure that the product they have sent me is “Duplicate”. I have raised a complaint to him but no necessary actions have been taken to refund the money (or) the product.

    Please guide me.

  3. Even i have same issue with ebay and seller and been now 2 months without refund/ item, they are simply closing this gaurantee claim everytime and updating the old replys. They have frustrated me so much i will never suggest anyone to buy from ebay.in

    I have the same problem. They have unconditional guarantee ( 100%) but never fulfil their obligation. They asked for pictures of the damaged delivered goods in different formats, just to frustrate the claim and drag it on. They closed the claim on some stupid pretext and won’t reopen it.

    EBay is just another fraudulent business ripping off customers. They sign up all kinds of shady retailers, offer a false guarantee and collect a nice middleman’s commission. I don’t know of any claim they have actually paid out.

    Its time the govt. created an effective consumer forum. If they don’t do it soon, all these on-line portals are going to sign up every shady guy as sellers and take the consumer for a ride.

I am struggling to process my refund via Ebay, I had purchase one time for which I received damaged item and had returned back to the seller and had a word with seller he said that they are ready to refund the amount but through ebay and I need to open a case. I had opened a case in EBAY case , post which I have called ebay morethan 100times to the customer service toll free but everytime I receive a same answer that I will receive a call from EBAY in next 48 hrs and the refund will be processed, I am highly dissatisfied with the EBAY customer service and same was not expected by EBAY that such a big company and the processes are so weak that it takes 20 days to process the refund..you peoles are treating customers like begger…eventhough i have submitted all my details through attachment..you peoples are not caring me..now am in urgent for medical expence for my child…you peoples are going to return my product..not going to refund my money..

    On 19th December I ordered samsung 32gb memory card EVO class 10 from ebay india. my
    however when product was received on 24th December.
    i discovered that it was non-working condition as well as product was not correct or same which i was orderd from ebay.
    I ordered Samsung memory card Class 10 EVO.Instead of samsung HDHC class 10 32 gb memory card which was received today from ebay india..

    the seller name was Royal shop which was shipped non working memory card to me.it is really very pathetic service from ebay i didn’t expected such kinds of worst service the e-commerce brand like ebay india…
    the worst online shopping site I have ever seen.Everything product which is sold by ebay is fake.
    The condition of the item was your responsibility up to the point I received it and accordingly I am entitled to a replacement as soon as possible.
    I would request that you confirm in the next 3 days.

    if i do not get any confirmation from ebay india then I will have to drag out this mattrer to legally consumer court action on ebay india..

    I am looking for fruitful resolution from ebay india as soon as possible..

  7. Please refrain to buy anything from ebay, it is a fraud company. I bought microsd card, and they were completely non working, i was told to visit service center and they rejected the as they were fake. Recently i bought another product”a washing machine cover” which was not at all fitting, i asked for a refund, they denied saying we cannot look into this contact seller. If we have to do everything with the seller then what ebay making fool of innocent customers?

    Suggestion: Stay away from ebay, better buy from somewhere else those have a cuser friendly policies.

    This is Sonika Maurya from Mumbai, in the month of May 2016 i baught Samsung Note 4. As i received phone after 1 week i was facing problem in like noice and other software related issue, so i visited on Ebay.in website and as mentioned to contact seller first for redresal so as per that i contacted seller and ask for the details he ask me to wait for somedays i waited and again contacted after 3 , 4 days he told me some setting to do.

    I did the setting problem wasnt resolved but subside for time being again after a week time i started facing the problem and i called seller he told me the phone is imported so lil difference will be there so he ask me to wait and use it will be resolved and my phones battery use to drain within 3 to 4 hours so i contacted him again asking for this problem he dont use to receive my phone so i keep calling him frequently after 3 , 4 days he received and told me you buy new battery i will pay you from here and before 1 week my phone automatically shuts down and never switch on and then i called him ,he talk very nonsense to me and disconnected.
    And now he is even not picking my calls even i had register complain for the same on 20th only and your csa told me to send an final email to seller and she will contact seller too to reslove this problem again no reply. So i went to samsung gallary and found that this is china fake samsung phone which is quite annoying to me.
    I called yesterday to your CSA asked me she have raised complain for the same and SR no : L84084739690.
    So my concern is seller have not replied to you guys neither to me.
    Now i need redressal for the same , how ebay will help me for this. He is fake seller and gave me fake product.

    I want redressal from ebay for the same asap as i can see the chats in google its been hapnning since a long time with other custoemers too.

    I want my 100 % refund asap.
