In further reference to my letter, dated 25th April 2013, I brought to your notice that I purchased one “KARBONN A3 – Dual SIM Android Phone” from STAR CJ Alive. I ordered for one on 25th March 2013, at a Price of Rs. 4490.00, and opted for the EMI Payment.
The Item delivered to me was found DEFECTIVE.
I received the product in a sealed Box [INTACT Package] on 28th March 2013, evening. On receipt I checked the papers and opened the Box.
After using it for a day I started experiencing some erratic operation of the KEY PAD. It was alternately flickering amidst the cal, SMS or even Browsing. I immediately reported back to STAR CJ Live Customer Service Center within 36 Hrs, and finally lodged a complaint for Replacement of Defective piece on 30th March 2013 (Evening).
They suggested me to pay a visit to the KARBONN Authorised Service Center [MOBILE CARE] in Panchpakhadi, THANE, and they will solve my problem.
Immediately as advised by them, I visited to their following Address:–

After I shown him my Hand set, they said it is a software problem and they will upgrade it.
After leaving the handset for few hours with them, when I collected the same, it was working satisfactorily. I came back home with a pleasant satisfaction. But as soon as I reached home (say after 3 Hrs) the problem reappeared.
I immediately called Mr. Lalit of MOBILE CARE and reported about the recurrence of the problem. He called again for a relooking. Every time he upgrades the software and reboots the handset, it works well for few hours but again re occurs shortly.
This way I visited not less than 5 to 6 times in 7 days to the “KARBONN” Authorised Service Center for setting the defect of my Hand set. Even they kept my Handset for couple of days with them for observation.
On 8th April 2013, they ultimately declared that the handset has got some inherent problem and is not repairable. They sealed my Handset along with all its accessories in its Box and issued me a DOA Letter No. KJASPMH214CFD1195 Dated 09.04.2013
Since then I had been repeatedly calling STAR CJ Customer Care No. [18605001860] for the replacement of the product but met with all false promises and no results. Your customer Care Officer advised me to send the Scanned Copy of DOA Letter to your E-mail ID [email protected] , and accordingly, I sent the same on 13th. April 2013
They were not responding and ultimately when I threatened them for reporting the problem to Consumer court they got alerted, and on 17th. April 2013 they assured me that the Replacement Order has been issued and within 7 working days (i.e. before 25th. April 2013) replacement will be sent. But till date (i.e. upto 03rd May 2013) I did not receive any replacement.
Although I called them a couple of times to know about the development, but unfortunately, till date they are totally silent and never made me aware about their course of action. Whenever I call them, they maintain that the replacement has been sent vide “Docket No. X9003264 of “TANVI EXPRESS COURIER” and the delivery is pending with the courier agency. It is hard to believe that the matter is pending with the courier agency for so long and they couldn’t deliver the product In last 15 days.
I have already raised my complaint to “The Consumer Forum” and as advised by them, I am sending you this Letter as “LAST REMINDER AND LEAGAL NOTICE” and serving you a Notice for 8 days from the date of this letter for doing the needful. In the absence of any action from your side a legal proceeding shall be initiated against your company for the recovery of the cost of the product along with the penalty for the harassment and causing mental agony to me.
